CROWN TOOLING
STANDARD CONDITIONS OF SALE.

1. PLACE OF ORDER: All orders are deemed to be established in Sydney, New South Wales, Australia.

2. RESPONSIBILITY OF DELIVERY: Our responsibility for delivery ceases on delivery to Courier, Post Office, or other Carrier etc. Any date given by CROWN TOOOLING is intended only as an estimate and CROWN TOOLING shall not be held responsible for the consequences of any delayed delivery.

3. INSPECTION OF GOODS: It is the responsibility of the purchaser to inspect the goods received to ensure that they are in good condition and correctly delivered before use. Any claims shall be made within 10 working days of date of invoice.

4. RETURN OF GOODS: The return of goods will not be accepted after 14 days from the date of invoice unless authority is given by CROWN TOOLING. Goods returned should be adequately packaged with all original accessories, spare parts, and the reason for return clearly stated. Freight is to be paid by the sender. Insurance on the goods is the responsibility of the sender.

5. TERMS OF PAYMENT: Terms of payment are net 30 days for the whole amount shown on the invoice for approved credit customers only. All other invoices are strictly C.O.D. Title in and beneficial ownership of the goods remains with CROWN TOOLING, notwithstanding delivery to the purchaser, until the full price and any other monies outstanding has been paid. CROWN TOOLING shall be entitled at any time to enter the purchasers premises to recover and dispose of the goods. The purchaser shall make no claim against CROWN TOOLING in respect of such entry and disposal, save to recover any balance due to the purchaser after CROWN TOOLING has disposed of the goods and recovered all sums due to CROWN TOOLING.

6. SPECIAL GOODS: Items specially made to customers specifications, drawings, sketches or other data are not returnable, nor refundable.

7. GUARANTEE: Goods are guaranteed against faulty material and workmanship for a period of 12 months only and should be returned to the distributor or CROWN TOOLING for inspection and approval.

8. PERFORMANCE: As the conditions of use are out of control of CROWN TOOLING, no guarantee of performance is given.

9. ADVICE: Any advice, recommendations, information, assistance, or other data, is given in good faith. However such advice or recommendations shall be given, and accepted, without liability on the part of CROWN TOOLING. It shall be the responsibility of the purchaser to confirm the accuracy and reliability of the same in regard to the use to which the customer makes, or intends to make, of the goods.

10. UNATHORISED REPRESENTATION: The purchaser has no authority to make any representation, that may render CROWN TOOLING liable to any third party, for breech of contract or warranty.

11. LIABILITY: It is the responsibility of the purchaser and end user to ensure that the goods are used in a safe and professional manner, To the extent permitted by law, CROWN TOOLING shall not be liable for any loss, death or injury of any kind occasioned to the Customer, or its agents ,as the result of goods supplied, whether caused by negligence, wrongful act or default of CROWN TOOLING or by any other cause whatsoever.

12. CHANGES IN PRICES OR INFORMATION: Due to a policy of continual improvement, CROWN TOOLING reserves the right to vary the price of all its’ products without prior notice. Catalogues and other information are also subject to change without prior notification, and should only be considered as a guide. Where specific information is required, CROWN TOOLING, or their authorised representatives, should be consulted.

13. DEFAULT OF BUYER: If these terms and conditions are not strictly observed by the customer, Crown Tooling may in its absolute discretion, refuse to supply to the customer and Crown Tooling shall not be liable to the customer for any loss or damage the customer may sustain as a result of such refusal. The costs of collection of any money that is due and payable by the customer, including the fees of any mercantile agent or lawyer engaged by Crown Tooling shall be payable by the customer.
